Agreement to Terms
These Terms of Service ("Terms") are a legally binding agreement between you and Blunt AI FZ-LLC ("Blunt," "we," "us," or "our") governing your use of the Blunt mobile applications and web platform (collectively, the "App").
By using the App, you agree to these Terms. If you disagree with any part, do not use the App.
Eligibility
Age requirements
You must be at least 13 years old to use Blunt. If you are between 13 and 18 (or the age of majority in your jurisdiction), you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
Account registration
To use Blunt, you must:
- Provide accurate and complete information when creating an account.
- Keep your account credentials secure.
- Update your information if it changes.
- Accept responsibility for all activity under your account.
You may not:
- Create accounts with false or misleading information.
- Share your account or use another person's account.
Description of Service
Blunt is a platform that measures and displays public sentiment about topics, which we call entities. An entity can be a person, company, product, place, event, concept, or other subject. You can:
- Search for entities by typing, by speaking, by uploading a photo, or by identifying music playing near you.
- View a Blunt Score, a 0 to 100 measure of sentiment that our system generates using artificial intelligence models and publicly available information.
- Score entities, post reviews, and share your own opinions.
- Save entities, build collections, and explore trending topics.
- Follow other users, comment, and react to reviews.
We reserve the right to modify, suspend, or discontinue any aspect of the App at any time without notice.
How scores are generated
Blunt Scores are produced by automated systems, including third-party artificial intelligence models, applied to publicly available information gathered from the web. Scores are aggregated estimates of sentiment and AI-generated opinion. They are not statements of fact, not professional advice, and not a measure of a person's worth, character, or reputation. Do not rely on a Blunt Score for any important decision, including decisions about employing, transacting with, or evaluating any person or organization.
Scoring of people
Some entities are real, identifiable people. The following applies to those pages, in addition to the rest of these Terms.
- A page about a person reflects aggregated public sentiment and AI-generated opinion drawn from publicly available sources. It is not a verified profile of that person and is not endorsed by them.
- We distinguish, where reasonably possible, between public figures and private individuals, and we apply greater restraint to private individuals.
- If you are the subject of a page, or their authorized representative, you may request review, correction, or removal of that page by contacting support@blunt.ai. We will review such requests and may remove or restrict a page at our discretion, including where required by applicable law.
- You may not use the App to harass, defame, threaten, or target any individual, or to create or promote a page whose purpose is to demean a private person.
User content and conduct
Your content
When you upload photos, post reviews, score entities, comment, or submit other content ("User Content"), you:
- Retain ownership of your User Content.
- Grant us a worldwide, non-exclusive, royalty-free, transferable, sub-licensable license to host, use, reproduce, modify, adapt, publish, translate, distribute, publicly display, and analyze your User Content for operating, improving, and promoting the App.
- Represent that you own or have the rights to your User Content.
- Represent that your User Content does not violate any law or any third-party right, including privacy, publicity, and intellectual property rights.
Images of other people
If you upload a photo that shows another person, you represent that you have the right to do so and any consent required by law. Do not upload images to identify, surveil, or expose a private individual.
Visibility of your content and activity
By default, your Blunt account is public. This means other users and visitors can see your username, profile, ratings and scores, reviews, comments, collections you make public, and your followers and the accounts you follow. Aggregated, anonymized sentiment derived from user activity is also displayed publicly in the App.
Private accounts
You can set your account to private in your account settings. While your account is private, your ratings, reviews, profile details, and follower and following lists are hidden from other users, subject to the limits described in the Privacy Policy. Content you posted while public may already have been seen, cached, or shared, and aggregate sentiment may still reflect your past activity in anonymized form.
Prohibited conduct
You agree not to:
- Violate any applicable law or regulation.
- Upload illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or hateful content.
- Upload content that sexualizes minors or depicts minors in any inappropriate context.
- Impersonate any person or entity.
- Post content that infringes intellectual property, privacy, or publicity rights.
- Transmit viruses, malware, or other harmful code.
- Attempt unauthorized access to the App or its systems.
- Interfere with or disrupt the App.
- Scrape, harvest, or collect data about other users.
- Use bots, scrapers, or other automated systems to access the App.
- Reverse engineer, decompile, or disassemble any part of the App.
- Use the App for commercial purposes without our written permission.
Reporting and moderation
- You can report objectionable content or abusive behavior from within the App.
- We review reports and act on content that violates these Terms, and we aim to remove objectionable User Content promptly after we become aware of it.
- We reserve the right, but have no obligation, to monitor User Content, to remove or refuse to display any User Content, to suspend or terminate accounts that violate these Terms, and to cooperate with law enforcement.
Intellectual property
Our property
The App and its original content, features, and functionality (excluding User Content) are owned by Blunt and protected by international copyright, trademark, and other intellectual property laws. Our trademarks may not be used without prior written permission.
Your license
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
Copyright and takedown
We respect intellectual property rights and expect users to do the same. If you believe content in the App infringes your copyright, send a notice to our designated copyright agent at copyright@blunt.ai. The information your notice must include, our designated agent details, how we respond, and how to file a counter-notice are set out in full on our Copyright page. We remove or disable material that we determine to be infringing and may terminate repeat infringers.
Right of publicity
Pages may reference the names, images, and likenesses of real people gathered from public sources. If you are an individual and object to the use of your name, image, or likeness in the App, contact support@blunt.ai and we will review your request.
Payments
The App is currently free to use. If we introduce paid features or subscriptions, we will present the price and terms before you purchase, and purchases made through the Apple App Store or Google Play are also subject to those stores' terms. Unless required by law or stated otherwise at purchase, fees are non-refundable.
Third-party services
The App relies on third-party services for cloud infrastructure, authentication, data storage, search, artificial intelligence and language analysis, analytics, advertising measurement, and other functionality. Your use of the App may be subject to the terms and privacy policies of those providers. We are not responsible for the practices of third-party services. Blunt Scores and data displayed in the App are generated by automated systems from publicly available information, and we do not endorse or guarantee the accuracy of that content.
Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
Disclaimers
"As is" service
The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or security.
We do not warrant that the App will be uninterrupted, secure, or error-free, that results obtained from the App will be accurate or reliable, that any errors will be corrected, or that the App will meet your requirements.
Sentiment accuracy
Blunt Scores are AI-generated estimates from publicly available information. They reflect aggregated opinion, not verified facts. Do not rely solely on this information for any important decision.
User content
We do not endorse, verify, or guarantee the accuracy of any User Content. Reliance on User Content is at your own risk.
Limitation of liability
To the maximum extent permitted by law, Blunt and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the App, any conduct or content of third parties on the App, any User Content, or unauthorized access to or alteration of your data.
Our total liability for any claims arising from the App shall not exceed the greater of one hundred US dollars ($100) or the amount you paid us in the twelve (12) months preceding the claim.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability, so some of these limitations may not apply to you.
Indemnification
You agree to defend, indemnify, and hold harmless Blunt and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, or expenses (including attorney's fees) arising from your use of the App, your violation of these Terms, your violation of any third-party right, or your User Content.
Termination
By you
You may delete your account at any time through the App settings or by contacting support@blunt.ai.
By us
We may suspend or terminate your account immediately, without prior notice, for violation of these Terms, fraudulent, abusive, or illegal activity, extended inactivity, or at our sole discretion.
Upon termination, your right to use the App ceases immediately. We may delete your account and User Content. Provisions that by their nature should survive termination will survive.
Dispute resolution
Governing law
These Terms are governed by the laws of the United Arab Emirates, without regard to conflict of law provisions.
Arbitration
Any dispute arising from these Terms or the App shall be resolved through binding arbitration under the rules of the Dubai International Arbitration Centre (DIAC), rather than in court, except that you may assert claims in small claims court if they qualify.
Class action waiver
Disputes will be resolved only on an individual basis, not as part of a class, consolidated, or representative action.
Exceptions
Either party may seek injunctive relief in court to stop unauthorized use or abuse of the App or infringement of intellectual property rights.
General provisions
Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Blunt regarding the App.
Changes to Terms
We may update these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, for significant changes, sending a notification. Continued use after changes are posted means you accept the updated Terms.
Severability
If any provision is found unenforceable, it will be limited to the minimum extent necessary, and the remaining provisions remain in full force.
Waiver
Failure to enforce any provision is not a waiver of that provision.
Assignment
You may not transfer these Terms or your account without our consent. We may assign these Terms without restriction.
Force majeure
We are not liable for failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, pandemics, or government actions.
Language
These Terms may be translated for convenience. In case of conflict, the English version prevails.
